1. Introduction
These Terms and Conditions govern the use of the Smart Workspace Design website and the registration for events, trainings, webinars, workshops, digital content, or related services offered through this website by Fleming Trainings, s.r.o. (“Fleming”, “we”, “us”, or “our”).
By submitting a registration form, placing an order, requesting an invoice, or otherwise using this website, you agree to these Terms and Conditions.
2. Scope of Services
Smart Workspace Design may offer, depending on the specific event or program:
- in-person conferences, summits, workshops, and trainings,
- online live sessions, webinars, and digital access products,
- downloadable or electronically accessible event materials,
- related networking, educational, or professional services.
The exact scope of each product or service is described on the relevant event or registration page.
3. Registration and Contract Formation
A registration submitted through this website constitutes a request to participate in the selected event or service.
A binding contract is formed once we confirm your registration in writing, typically by email, or once we issue an invoice and accept your order.
We reserve the right to reject or cancel any registration where necessary, including in cases of incomplete information, non-payment, capacity limits, compliance concerns, or suspected misuse.
4. Prices and Payment Terms
Unless stated otherwise, all prices shown on this website are in EUR and include applicable taxes.
Payment may be required by online payment or by invoice, depending on the offer. If payment is made by invoice, the invoiced amount is due within the period stated on the invoice.
Access to the event, service, or digital content may be refused, suspended, or cancelled if payment is not received in full by the due date.
Where permitted by applicable law, Fleming reserves the right to claim statutory default interest and any reasonable recovery costs in the event of late payment.
Unless expressly stated otherwise, the registration fee includes only those items listed in the specific event description. Travel, accommodation, transfers, insurance, visas, and other personal expenses are not included.
5. Accommodation
Accommodation is not included in the registration fee unless explicitly stated.
If Fleming arranges a preferred hotel rate or room block, this will be communicated separately. Hotel availability, room allocation, and hotel terms remain subject to the relevant hotel’s policies and capacity.
6. Cancellations by the Participant
All cancellation requests must be submitted in writing by email.
Unless a specific event page states otherwise, the following cancellation policy applies:
- if cancellation is received more than 30 calendar days before the event start date, Fleming may issue a credit note equal to 50% of the invoiced amount, valid for 12 months for another Fleming event or service,
- if cancellation is received 30 calendar days or less before the event, or if the participant does not attend, no refund or credit will be due.
A substitute participant from the same company may attend instead of the original registrant, subject to prior written approval by Fleming.
Failure to attend does not cancel the payment obligation.
7. Changes or Cancellation by Fleming
We make reasonable efforts to deliver each event or service as advertised. However, we reserve the right to make changes where reasonably necessary, including changes to:
- agenda or content,
- speakers, moderators, or trainers,
- format, timing, dates, or venue,
- delivery method, including switching to an online format,
- event branding or event combination with another related event.
If Fleming cancels an event entirely, we may offer, at our discretion:
- transfer to a replacement event,
- a credit for future Fleming services, or
- a refund of the amount actually paid to Fleming for the cancelled event.
Unless required by mandatory law, Fleming is not responsible for travel costs, accommodation costs, visa costs, loss of business, or any indirect or consequential losses incurred due to event changes, postponement, or cancellation.
8. Digital Content and Access
Where digital materials, recordings, or online content are provided, access is granted only to the registered user or the person approved by Fleming as a substitute.
You may not copy, resell, redistribute, publicly share, or provide unauthorized third-party access to any digital content, materials, recordings, event documentation, or online platform access credentials.
You are responsible for keeping your login credentials and access information confidential.
9. Intellectual Property
All content made available through this website or in connection with our events, including text, graphics, presentations, recordings, downloads, agendas, branding, and training materials, remains the intellectual property of Fleming or its licensors unless stated otherwise.
No rights are transferred except the limited right to use the materials for your own internal and lawful professional purposes.
10. Liability
To the maximum extent permitted by applicable law, Fleming excludes liability for indirect, incidental, special, or consequential damages, including loss of profit, loss of revenue, loss of business opportunity, or reputational harm.
Nothing in these Terms excludes or limits liability where such exclusion is not permitted by law, including liability for fraud, wilful misconduct, or personal injury caused by negligence.
11. Consumer Rights
Where mandatory consumer protection laws apply, nothing in these Terms limits any rights that cannot legally be excluded.
For certain event services provided on a specific date or within a specific period, or for digital content supplied immediately with your prior express consent, a statutory right of withdrawal may not apply to the extent permitted by applicable law.
If you are unsure whether consumer rights apply to your purchase, please contact us before completing your registration.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Slovak Republic.
Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the competent courts of the Slovak Republic, unless mandatory law provides otherwise.
